Welcome to Fovo! These Terms of Service (“Terms”) govern your use of Fovo’s video platform, where you can browse, view, share, and engage with user‑uploaded videos at no cost. By accessing or using Fovo, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Services.

2. Eligibility

- You must be at least 18 years old to create an account or use Fovo.

- You confirm you have full legal capacity to enter into a binding agreement.

- If you use Fovo for a business or government entity, you represent you have authority to bind that entity to these Terms.

- We may suspend or terminate accounts we reasonably believe belong to users under 18.

3. License to Use Fovo

Fovo grants you a personal, worldwide, royalty‑free, non‑transferable license to access and use the Services for their intended purpose, subject to these Terms. You may not copy, modify, sell, reverse engineer, decompile, or sublicense any part of Fovo without our prior written consent. The Services may automatically update; you may manage updates in your device settings.

4. Your Content & License to Fovo

You retain full ownership of content you upload, post, or share (“Your Content”). You grant Fovo a perpetual, worldwide, royalty‑free, sublicensable license to host, store, display, stream, adapt, distribute, and promote Your Content solely to operate and improve the Services. For public content, this license includes use in trending sections, promotions, and derivative works, with no additional compensation.

Fovo may review, remove, or edit Your Content at any time if it violates these Terms or applicable law. You are solely responsible for Your Content.

5. Prohibited Content & Conduct

You may not upload, share, or engage in:

- Illegal, harmful, violent, discriminatory, sexually explicit, or harassing content

- Child sexual abuse material (CSAM) or exploitation of minors

- Infringement of copyright, trademark, or other intellectual property rights

- Malware, spam, or automated tools (bots, scrapers) that disrupt the Service

- Impersonation, harassment, or threats toward other users

- Unauthorized commercial activity or fraud

- Circumvention of security or DRM systems

Fovo has a zero‑tolerance policy for CSAM. Report violations immediately via our in‑app tool or [email protected].

6. Account Security

You are responsible for safeguarding your account credentials. Do not share your password, use third‑party tools to access your account, create multiple accounts without permission, or sell/transfer your account. Notify us immediately of unauthorized account use.

7. Copyright Policy

If you believe content on Fovo infringes your copyright, send a written notice to [email protected] including:

- Your physical or electronic signature

- Description of the copyrighted work

- Location of the infringing material

- Your contact details

- A good‑faith belief statement under penalty of perjury

Repeat infringers may have accounts terminated.

8. Privacy

Your use of Fovo is governed by our Privacy Policy, which explains how we collect, use, and protect your information.

9. Purchases & Payments

If Fovo offers premium features in the future:

- Prices will be clearly displayed before purchase.

- Payments are processed via third‑party platforms (App Store, Google Play).

- Most purchases are final; refunds are available only as required by law.

- Subscriptions auto‑renew unless canceled at least 24 hours before renewal.

- EU users may request a refund within 14 days if unused.

10. Service Changes & Termination

Fovo may modify, suspend, or discontinue Services at any time. We may terminate or suspend accounts for violations, inactivity, or harmful conduct. Upon termination, you lose access to your account and content.

11. Disclaimers

Fovo is provided “as‑is” and “as‑available” without warranties of any kind. We do not guarantee uninterrupted service, error‑free playback, or safety/accuracy of user content. You use user‑generated content at your own risk.

12. Limitation of Liability

Fovo shall not be liable for indirect, consequential, or punitive damages. Total liability shall not exceed $100 USD or the amount you paid to Fovo in the prior 12 months, whichever is greater.

13. Arbitration & Disputes

Most disputes shall be resolved by binding individual arbitration; class actions are waived. You may opt out within 30 days of first use by emailing [email protected] with your account details and opt‑out statement.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules.

15. General Provisions

- These Terms, together with the Privacy Policy, constitute the entire agreement.

- We may assign these Terms; you may not.

- If any provision is invalid, the remainder remains enforceable.

- The English version controls in case of translation conflicts.
